Copyright Policy for The Glenlivet Project and Clicktrees.com


Clicktrees.com, operators of this site, recognize the various copyright laws in place in countries around the world and have created this copyright policy to mitigate any concerns over ownership of material that is contributed to the project.

Overview:

Facts can not be copyrighted. Compilations of names, dates, places, relationships are not subject to copyright protection. Published family trees become public domain the moment they are published.
Notes, comments, sources, e-mail, message board posts, and original prose in any form can be copyrighted and permission must be obtained from the author before using. Photographs are subject to copyright protection and permission must be obtained from the creator of the photograph. Scanning or digitally reproducing an image or document does not change the copyright status. Copyrights on original material expire based on the time that has elapsed, whether the author has renewed the copyright, and which country the original work was published in. As a general rule of thumb in the US, published works that are older than 1923 are no longer protected by copyright and published works before 1989 without proper copyright notice are also public domain. As I am not a copyright lawyer, all of the statements made in this copyright policy page are personal opinions. If you have specific questions, you should consult an expert.

What about Fair Use?
In the US, researchers are allowed to copy limited amounts of an author's original work for personal use as long as: 1) the material is for non-profit educational use, 2) There is a limited amount of copying 3) The copying does not diminish the market value or usefulness of the original work.
What about all the time and effort I made in compiling my family tree?
Copyright law only deals with original work. Compilations of existing facts have no protection under copyright law because you did not create the facts. If there is some originality in the way the facts are presented, there can by copyright on that presentation, but the facts are still public domain. If someone takes your work and presents it as their own, this is called plagiarism and is considered very bad form, but it is not covered by copyright law.
What information is copyrighted on the Clicktrees website?
Clicktrees.com owns the copyright to the design, layout, and imagery used on the Clicktrees website. All other material is in the public domain.
What should be done if I think a copyrighted work is on Clicktrees.com?

You must submit only material which belongs to you and which will not violate the property or other rights of other people or organizations. We are sensitive to the copyright and other intellectual property rights of others and will remove material that is shown to be in violation of copyright law. We will not monitor User Provided Content, with the exception that, to promote privacy, an automated filtering tool will be used to suppress and omit from display information submitted to the user submitted family tree elements of the Site which appears in our best judgment to pertain to a living person.
So can I just download whatever I want from Clicktrees.com and use it as my own?
Any genealogist worth anything will tell you that if you do not quote the source of your material, the assertion made in your genealogy is useless. Yes, you could take the facts from this website and use them without giving a source citation back to Clicktrees.com. But, if anyone using your information in the future would like to check the source for accuracy, the link to the original source will be broken. The data will become useless and you will have accumulated some really bad genealogy karma.
